RE: Phase 14 MOAs



Hi Chun Yi,

This is a separate issue than that Dennis raised. Historically, we have
reimbursed payment requests well beyond the dates specified in the MOA with
no problems raised by either the agencies or the GLC. While we haven't
traditionally bother to put any amendments in place, that could easily be
accomplished if it is needed for some reason. However, if there's no
pressing need, it creates far more paperwork than it is worth. 

Dennis' issue regards spending funds for which there is currently no
agreement in place. That, in my mind, is a more pressing concern. 

I've just received another email confirmation from our EPA grants officer
again stating that the confirmation is on the way. At this point, I think it
makes sense for people to initiate the process of having the MOAs signed on
your end and sending them our way. By the time they arrive, the confirmation
from the EPA should almost certainly be here. The draft I sent previously
had some bracketed field, such as [agency name], etc., included. If you'd
like a version where those are converted to the content for your state, let
me know and I can produce these rather quickly. 

This is also an opportune time to remind people to get up-to-date on your
states billing if you haven't checked recently. All funds up to and
including phase 13 must be paid by this coming summer.

Phase 13 MOA ends on 9/30/07.  We could not use any funds without an
amendment technically.

I spoke with our grant officer at EPA last week and she continued to
indicate that this funding was certain and just a matter of the
necessary
paperwork being completed. Clearly it would be nice to have this taken
care
of prior to the required travel. However, I think it would be unwise
for the
GLC to commit itself to the expenditure of funds before a written
commitment
is received from the EPA that the funding is available to support it.
The
states are in a similar position without an MOA. If this causes
problems for
you in getting travel approval, I wonder if an interim solution can be
worked out where we could provide a letter committing to reimburse
your
agency for the cost of your travel in the event that the funding does
not
materialize, or just commit to support the travel and figure the
accounting
into the MOA when it does get put in place. Please let me know if this
would
help at all. 

In the meantime, I'll check with the EPA once again, as the end of the
federal fiscal year is fast approaching, as well as check within the
GLC
regarding any likelihood of signing MOAs prior to EPA funding
notification.

Thanks for bringing this up. If others also see this as a constraint
to
their traveling, please let me know and we will see what can be worked
out.

Hi, Jon!  Any word on EPA's progress in authorizing the grant money
needed to implement Phase 14?  It would be nice to have the MOAs in
place before the meeting in October-- although if the State of
Michigan
shuts down after October 1 due to its budget crisis, the timing of the
MOA may not be as important...
