GENESEE COUNTY NSR PERMITS UPDATE
The latest information that we have from MDEQ (2:30 PM, 6/9/97) on the Genesee County Court decision by Judge Archie Hayman regarding air permits is as follows.
There has been an "informal" clarification by the Court, apparently through news media inquiries, that the Judge intended the ruling only to apply to Genesee County. MDEQ and the Attorney General's Office are informing the Judge/Court that they are also interpreting the ruling as applying only to Genesee County.
As of today (June 9, 1997), MDEQ Air Quality Division is processing New Source Review (NSR) Permits as usual for all counties except Genesee. It is unclear whether the MDEQ Director is still maintaining control over the Genesee County permits as previously announced; however, it is generally presumed that that is the case. The Director and Assistant Director were not available for clarification.
As far as we know, the 13 permits listed below are the only ones now in limbo as a result of the Court ruling.
