The U.S. EPA, DEQ, MEC and Michigan Chemical Council today announced an
agreement on amendments to reform Michigan's 16-month-old pollution secrecy
(alias "audit privilege and immunity) statute.  The amendments, if adopted
by the Legislature this fall, will resolve EPA's concerns about Michigan's
ability to enforce federal law in light of the 1996 law, and will also
resolve MEC's June 1996 petition to EPA challenging the state law.
Coupled with the proposed amendments is an Attorney General's opinion
clarifying and narrowly interpreting sections of the law that will not be
amended.
