Stop Backdoor Assaults on the Environment and Public Health

On 6/27, Sen. Levin (D-MI) and Sen. Thompson (R-TN) introduced legislation,
S. 981, that would significantly change how government agencies, such as
EPA, make rules.  While the sponsors have indicated that this is not their
intent, as crafted the bill would undermine critical environmental, public
health, and safety protections, including new food safety and drinking water
legislation enacted by the last Congress.  Under the bill, agencies would be
forced to justify health and safety protections based on unworkable
"greatest net benefits" and "most cost-effective" tests, no matter how
important those protections are for safeguarding public health and the
environment.  Lawyers of polluting industries would have the opportunity to
challenge crucially important safeguards on the basis of these economic
tests in court.

==  What to do ==
Contact the following members of the Governmental Affairs Committee which
plans to hold a meeting on S. 981 this month. Let them know that S. 981
would jeopardize current and proposed environmental and public health laws.
Tell them many changes were already made to the regulatory process last
Congress -- like the Small Business Regulatory Enforcement Fairness Act and
the Unfunded Mandates Reform Act -- and these laws should be given the
opportunity to work before new, broad, bureaucratic mandates are enacted
that would weaken public health and environmental safety protections.
