An audit of the DEQ's Air Quality Division done by the Legislature's
Auditor General compliments the agency for eliminating permit backlogs and
assessing "economic benefit" penalties to polluters, but finds a number of
problems in the Division's compliance and enforcement program.

Dated January 1998, the audit notes that the Detroit/Ann Arbor area's ozone
standard attainment makes it the largest metropolitan area to achieve such
status in the country and finds that DEQ assessed in 1995-96 over $2.5
million in penalties for the economic benefit polluters reap from
noncompliance, while three other Region 5 EPA states did not usually assess
such penalties.

But the audit also finds that the DEQ is not always timely in enforcement
activities and resolution of violations, sometimes fails to document the
disposition of citizen complaints about pollution or to let citizens know
how their complaints were resolved, and needs to improve the effectiveness
of its compliance inspections.
