Congressional Subcommittee to Vote on Right-to-Know

House Transportation and Infrastructure Committee's Water 
Resources Subcommittee is scheduled to BEGIN markup Rep. 
Boehlert's Superfund bill H.R. 2727 THIS WEEK on Wednesday 
March 4.

CALL SUBCOMMITTEE MEMBERS FROM YOUR STATE 
AND URGE THEM TO 
[1] OPPOSE THE BOEHLERT SUPERFUND BILL; AND
[2] SUPPORT THE PASCRELL RIGHT TO KNOW 
AMENDMENT

H.R. 2727 has too many loopholes that will, taken together, result 
in inadequate cleanups.  It allows clean ground water to get dirty 
in too many instances, weakens treatment requirements, and 
exempts Superfund cleanups from requirements that apply to all 
other hazardous wastes.  It contains weak community 
participation provisions and fails to provide the public with the 
Right to Know about toxic chemical use.

In addition, H.R. 2727 undercuts the polluter-pays principle.  For 
example, the bill's pay-the-polluters provision requires the 
Superfund Trust Fund to partly reimburse polluters who already 
agreed to carry out cleanups, an unwarranted windfall.  It also lets 
large businesses off the hook for messes created by oil recycling 
operations.  Finally, the bill's provisions on natural resource 
damages fail to provide for full restoration and public 
compensation.

Members of the environmental community (PIRG, NRDC, EDF) 
are working to line up strengthening amendments.  Representative 
Pascrell (D-NJ) is prepared to offer a Right to Know amendment 
that will do the following:

[o] Give Superfund NPL site neighbors and researchers easily-
accessible information on the sources of hazardous substances to 
which site neighbors may be exposed.

[o] Requires owners and operators of Superfund facilities and 
Toxics Release Inventory (TRI) reporters to report the following 
information: 

         For Superfund facilities, each CERCLA hazardous 
substances of which more than 10,000 lbs is present at the 
facility;

         For Superfund and TRI facilities, certain pertistant 
bioaccumulative toxic chemicals (e.g. lead, mercury, dioxin, 
cadmium, chromium), if released from the facility at higher than 
naturally occurring background levels;

         For TRI-covered facilities only, a materials accounting, 
including starting and ending year inventories, amounts brought 
on and shipped off-site, amounts produced, destroyed, and 
shipped off-site in products and in wastes; and

         For TRI-covered facilities only, an estimate of employees 
at the facility exposed to toxic chemicals.
