E-M:/ wetland fee bill passes senate

The State Senate approved a bill (H.B. 5114) which establishes wetland
permit fees for the first time. The $450,000 in expected revenue will
assist with permit processing as well as compliance and enforcement
activities.  Fees will range from $100 for small projects such as driveways
to $2,000 for major developments.  The vote on the bill was 27-8, with two
Senators, Hoffman and Schuette, absent. Voting "no" were Sens. Conroy,
Gougeon, Jaye, Koivisto, O'Brien, Stille, Vaughn, Young.

An amendment to lower the fee for small projects to $50 was narrowly
defeated 18-17 (20 votes required for passage), but in an effort to head
off still worse amendments, supporters of the bill agreed to a change
requiring DEQ to review and make a report on the state definition of a
wetland subject to regulation.

The bill goes to the House for final concurrence and then to the Governor.

The Senate also approved an oil and gas fee bill, H.B. 5399, by a vote of
