The Environmental Policy Project at Georgetown
University Law Center has recently published
a paper by Fordham University professor, William
Michael Treano, titled, "The Original Understanding
of the Takings Clause."

According to the Policy Project, "Treanor's
basic argument is that, contrary to the claims
of modern takings advocates, the founding
fathers never intended the Takings Clause to
apply to regulations under any circumstances."
Treanor examines the historical context of
James Madison's constitutional amendment
and concludes that the Takings Clause of the
Constitution applied originally only to the
physical confiscation of property, contrary
to the claims of modern day property rights
advocates.
