E-M:/ Republican Opposition to Takings Bill

-------------------------------------------------------------------------
Enviro-Mich message from juliemec@voyager.net (Julie Stoneman)

TAKINGS ALERT--Here's the latest from NWF on the nasty takings bill that
may be on the U.S. Senate floor next week. HR 1534 would allow developers
to bypass local and state appeals processes for land use decisions and jump
to federal court with takings disputes. If passed, it would make the
Michgan Supreme Court victory in K&K Construction virtually meaningless.
When I last checked with Sen. Abraham's office they admitted to some
"problems with the bill." However, he has been a staunch supporter of
extremist takings measures and needs to hear from constituents.

Please call his office TODAY (and Levin's too) asking him to oppose HR 1534
and to ask Sen. Trent Lott to not bring the bill to the Senate floor.
Thanks.--Julie

Sen. Spencer Abraham ph: 202-224-4822
Sen. Carl Levin ph: 202-224-6221

>Latest information from Sen. Majority Leader Lott's office is that the
>takings /private property bill, H.R. 1534, is scheduled for a cloture
>(filibuster) vote for Mon. July 13 or Tues. July 14.
>Sen. Chafee (R-RI) will be seeking Republican signatures on a letter to
>Lott, urging him not to bring the bill to the Floor.
>
>Please contact your Senators (Capitol Switchboard 202-224-3121), and ask
>that they: 1) oppose the pending takings/property rights bill; and (2)
>(especially for Republicans) urge them to ask Senate Majority Leader Trent
>Lott (R-MS) not to bring the bill to the Senate Floor.
>
>Because H.R. 1534 targets local planning and zoning and is strongly
>opposed by virtually all state and local government organizations, every
>Senator may be receptive to grassroots arguments that the bill should not
>be brought to the Floor. Please tell me of any oral or written feedback.
>
>The Senate Judiciary Committee combined two House passed bills, HR 992 and
>HR 1534, into the *Citizens Access to Justice Act* under the House number,
>HR 1534. Below is a list of the Republican Representatives who voted for
>a substitute to one of the bills and/or against the passage of either or
>both House bills. They are arranged alphabetically by state. When
>contacting your Senators be sure to mention any of these Representatives
>from your state, to show the bipartisan opposition to various portions of
>the Senate bill. There were even nine Republican co-sponsors who
>ultimately voted against the bill, they are Brian Bilbray (CA), Benjamin
>Gilman (NY), Steve Horn (CA), Nancy Johnson (CT), John Porter (IL), Marge
>Roukema (NJ), Mark Sanford (SC), Jim Saxton (NJ), and Chris Smith (NJ).
