According to this preliminary report, Spencer Abraham voted the wrong way on
this bill, depsite enormous pressure on him from citizens and local
governments. Nevertheless, thank you all for your efforts -- Tim

YOU!!!!

TONIGHT, THE US SENATE FELL WELL SHORT OF THE 60 VOTES NEEDED TO PROCEED 
TO THE "TAKINGS PROPERTY RIGHTS BILL (S. 2271), EFFECTIVELY DOOMING THE 
LEGISLATION.  THE VOTE WAS 52-42.  SEVERAL ABSENT MEMBERS, INCLUDING 
SENATORS BIDEN, GLENN AND TORRICELLI, WERE CLEARLY AGAINST THE BILL AND 
REPORTS INDICATED THAT SENATOR D'AMATO WAS UNDECIDED.   THE RECORDED 
OPPOSITION WAS BI-PARTISAN WITH SENATOR LEAHY (D-VT) AND SENATOR CHAFEE 
(R-RI) LEADING THE OPPOSITION ON THE FLOOR, JOINED BY SENATOR MURRAY 
(D-WA).  OTHER REPUBLICAN SENATORS VOTING AGAINST THE BILL WERE SENATORS 
GREGG (R-NH), ROTH (R-DE), JEFFORDS (R-VT), SNOWE (R-ME), AND COLLINS 
(R-ME).  IN ADDITION, MANY OTHER REPUBLICAN SENATORS WHO VOTED TO PROCEED 
TO THE BILL HAVE EXPRESSED OPPOSITION TO OR VERY STRONG RESERVATIONS 
ABOUT THE BILL. 

DEMOCRATIC SENATORS CONRAD (D-ND), DORGAN (D-ND), FORD (D-KY), HARRY REID 
(D-NV), AND LANDRIEU (D-NV) VOTED TO PROCEED TO THE BILL.

The bi-partisan Senate opposition has stopped this radical measure that 
would have allowed developers to bypass state courts, curtail the process 
for local resolution of land use and zoning disputes, and file premature 
and expensive cases against towns, counties and cities in federal court.
