September 16, 1998 (early morning) SENATE NOW SLATED TO VOTE ON KEMPTHORNE RIDER TODAY CALL THE SENATE IMMEDIATELY Folks, Yesterday's alert talked about all the great work you did to stop the Kempthorne anti-ESA bill, S. 1180. News that Senator Kempthorne (R-ID) was tired of waiting for S. 1180 to come to the floor as a stand alone bill and instead plans to attach the entire bill to the Interior Appropriations bill as a rider followed closely on the heels of crowing about this minor miracle! Knowing by now to expect the worse should have prepared us for yet another onslaught and we rose quickly to meet this latest "challenge." Kempthorne is going ahead on his plans and you and I have done a great job in mobilizing to stop him. I don't know about you, but I've gotten as least a half dozen alerts today about the Kempthorne rider and you can bet all this flying around of electrons equals at lot of action and a lot of calls to the Senate and the White House. Let's remember our pledge from yesterday's alert and double your calls to the Senate and the White House urging support for amendments to remove riders, stripping all the riders from the bill and now also stopping the Kempthorne anti-ESA rider. Let's also double our calls to friends and colleagues urging them to do the same. Please make your calls as soon as possible as events may move very quickly today. What happened yesterday? Bad news for mining reform. Senator Dale Bumpers (D-AR) proposed an amendment to the Interior Appropriations bill to strip a rider that intends to thwart implementation of stronger mining regulations (the "3809" regs rider). Senator Bumpers, the Mineral Policy Center and other groups fought a valiant battle to strip the rider, but Senator Bumpers' amendment was tabled by a vote of 58-40. What do we face today? We expect Senator Boxer's amendment to remove the oil royalties rider from the Interior appropriations bill will come to the floor first thing today. (See Section 131 in last week's On Top of the Hill.) After that we could see the Kempthorne rider or the Baucus amendment at any time. It's the same drill folks: Call your Senators and call the White House. Never give up, never say no, and never let them get you down.
