The Michigan House Conservation and Outdoor Recreation Committee has
scheduled action on HB 4651 on Thursday (11/4) at 8:00 am in room 307 of
the House Office Building.

HB 4651 prevents the MDEQ from taking any action to reduce the emission
of greenhouse gases unless specific enabling legislation is passed by
the legislature authorizing the program.  Certain sections of the bill
are limited to action taken pursuant to the Kyoto Protocol.  However,
the bill does not explain how to determine if in action is pursuant to
the Kyoto Protocol versus an action designed to protect public health in
general.

The bill appears to eliminate or limit many state programs, including
those designed to promote energy efficiency, renewable energy, and
methane gas collection.

The relevant portion of the bill states:

SEC. 5503A.  (1) SUBJECT TO SUBSECTION (2), THE DEPARTMENT

SHALL NOT DO ANY OF THE FOLLOWING:

        (A) PROPOSE OR PROMULGATE A RULE INTENDED IN WHOLE OR PART  TO
REDUCE EMISSIONS OF GREENHOUSE GASES, UNLESS THE LEGISLATURE  HAS
ENACTED SPECIFIC ENABLING LEGISLATION FOR SUCH A RULE.

        (B) EXPEND FUNDS TO REDUCE EMISSIONS OF GREENHOUSE GASES
PURSUANT TO THE KYOTO PROTOCOL OR DESIGN POLICIES OR PROGRAMS TO REDUCE
EMISSIONS OF GREENHOUSE GASES PURSUANT TO THE KYOTO PROTOCOL.

        (C) SUBMIT TO THE UNITED STATES ENVIRONMENTAL PROTECTION
AGENCY OR ANY OTHER AGENCY OF THE FEDERAL GOVERNMENT ANY LEGALLY
ENFORCEABLE COMMITMENTS RELATED TO THE REDUCTION OF GREENHOUSE GASES.

(2) SUBSECTION (1) DOES NOT APPLY IF THE UNITED STATES  SENATE RATIFIES
THE KYOTO PROTOCOL AND FEDERAL LEGISLATION IS    ENACTED IMPLEMENTING
THE KYOTO PROTOCOL.
