The Michigan House Conservation and Outdoor Recreation Committee
reported HB 4651 (H-2) (Sponsor - Rep. J. Kukuk) on Thursday (11/4). 

The bill was amended in committee to remove provisions which could have
interfered with state programs on energy efficiency, renewable energy or
compliance with the Clean Air Act.  In my opinion the bill still sends
the wrong message, but should have no effect on the actions of the
department. 

MEC submitted comments and spoke on the bill, our general message was:

"Whereas, the long-term health effects of greenhouse gases may be
uncertain in the minds of some, the massive potential harm posed by
greenhouse gases is reason enough to limit their emission.  Moreover, if
we consider the harmful nature of the related emissions from the same
sources, a state policy prohibiting the MDEQ from reducing greenhouse
gases is not supported by sound science."

support bill.

The relevant portion has been amended to state [CHANGES ARE IN
BRACKETS]:

SEC. 5503A.  (1) SUBJECT TO SUBSECTION (2) AND (3), THE DEPARTMENT

SHALL NOT DO ANY OF THE FOLLOWING:

        (A) PROPOSE OR PROMULGATE A RULE INTENDED IN WHOLE OR PART  TO
REDUCE EMISSIONS OF GREENHOUSE GASES [PURSUANT TO THE KYOTO PROTOCOL],
UNLESS THE LEGISLATURE  HAS ENACTED SPECIFIC ENABLING LEGISLATION FOR
SUCH A RULE.

        (B) EXPEND FUNDS TO REDUCE EMISSIONS OF GREENHOUSE GASES
PURSUANT TO THE KYOTO PROTOCOL OR DESIGN POLICIES OR PROGRAMS TO REDUCE
EMISSIONS OF GREENHOUSE GASES PURSUANT TO THE KYOTO PROTOCOL.

        (C) SUBMIT TO THE UNITED STATES ENVIRONMENTAL PROTECTION
AGENCY OR ANY OTHER AGENCY OF THE FEDERAL GOVERNMENT ANY LEGALLY
ENFORCEABLE COMMITMENTS RELATED TO THE REDUCTION OF GREENHOUSE GASES
[PURSUANT TO THE KYOTO PROTOCOL].

(2) SUBSECTION (1) DOES NOT APPLY IF THE UNITED STATES  SENATE RATIFIES
THE KYOTO PROTOCOL AND FEDERAL LEGISLATION IS ENACTED IMPLEMENTING
THE KYOTO PROTOCOL.

[(3) SUBSECTION (1) DOES NOT PROHIBIT THE DEPARTMENT FROM DOING ANY OF
THE FOLLOWING:
	(A) ENCOURAGING ENERGY EFFICIENCY.
	(B) ENCOURAGING THE DEVELOPMENT OF RENEWABLE ENERGY SOURCES.
	(C) ENFORCING THIS PART OR PROPOSING , PROMULGATING, OR ENFORCING RULES
TO IMPLEMENT THIS PART OR THE CLEAN AIR ACT.]
