NOTICE OF PENDING 401 CERTIFICATION AND DETERMINATION OF COASTAL ZONE
MANAGEMENT ACT CONSISTENCY. On March 9, 2000, the U.S. Army Corps of
Engineers (Corps) provided notice in the Federal Register of issuance of
five new Nationwide Permits and modification of six existing Nationwide
Permits, and requested that the Michigan Department of Environmental
Quality (DEQ) provide Section 401 water quality certification and a
determination of Coastal Zone Management Act consistency for these permits.
Nationwide Permits affect the authorization of dredge and fill activities
in the Great Lakes, adjacent wetlands, and other waters where the Corps has
permitting authority under Section 404 of the Federal Clean Water Act. The
March 9, 2000, Federal Register notice is available at the Detroit District
Corps of Engineers, Regulatory Office, 477 Michigan Avenue, Detroit,
Michigan, or on the Internet at
www.usace.army.mil/inet/functions/cw/cecwo/reg/. The DEQ must respond to
the request for certification prior to the June 7, 2000, effective date of
