Here's some clarification on my earlier "Court Affirms Odor Ordinance" email:

Technically, the case did not involve a constitional taking of private
property claim (under the Takings or Just Compensation Clause), but rather
claims under the separate constitutional Due Process Clause alleging
violations of substantive and procedural due process.

Also, this decision does not change the fact that Michigan's local
governments are still hampered by the Legislature's decision last year
(with S.B. 205) to take away local zoning authority over agriculture
operations.
