There are also very specific rules that apply if there is an
existing violation of water quality standards.

You may want to write an argument claiming that the dropping of
effluent limitations authorizes impermissible backsliding by allowing
uncontrolled effluents.

The operators of Ottawa Lake Quarry, StoneCo, have applied to the MDEQ
for an expanded NPDES permit governing the quantity and quality of their
mining water discharge into Halfway Creek.  Halfway Creek terminates at
Lake Erie at the Erie State Game Area.  Ottawa Lake Quarry is just north
of Toledo.

The permit would allow the quarry to increase their discharge from the
currently allowed amount of 96,000 gallons per day to 8,000,000 gallons
per day.  Also, the permit does not include the usual total dissolved
solids (TDS) limitation that previous stone quarry permits have.
Instead, a "Chronic Toxicity" standard is used which allows pollutants
to be dumped into the water up to the point where test species cannot
survive.  This is a NEW standard for "clean" water in Michigan, adopted
by the MDEQ upon request by the Michigan Aggregates Association!

The limitation in the Ottawa Lake permit on poisonous hydrogen sulfide
was dropped completely, even though this is a serious and common problem
at Monroe County limestone quarries.

We envision a destroyed community and environment similar to our own in
London and Augusta Townships.  Our quarry is London Aggregates, whose
parent company, SE Johnson, also owns StoneCo.  We have thousands of dry
wells, air that stinks, polluted creeks, and no enforcement yet in the 8
years of documented, continuous violations.  We continue with our
lawsuit against London Aggregates for over 2700 violations of the Clean
Water Act.
