    The implications of yesterday's Supreme Court
decision which weakens the reach of the federal Clean
Water Act appears at  


    This determination has very serious portents for
Michigan, since Michigan is a delegated-enforcement
state and the DEQ has repeatedly accepted all manner
of developer arguments to preclude regulation.
    In this article, environmentalists speculate that
as much as one-fifth (1/5) of the surface waters of
the U.S. might now be out of the reach of the Clean
Water Act. The Supreme Court bought the
"disconnectedness" argument, one that I've seen
applied by the Engler administration - that if you
can't _see_ the connection to other surface waters,
the wetland is not regulatable.

    This decision must be legislatively reversed at
the state and preferably, federal levels.
