Suttons Bay Wastewater Operator Bound Over for Trial on Nine Count
Felony Warrant

The former operator of the Village of Suttons Bay wastewater treatment
system was bound over for trial after a preliminary examination on
August 22, 2003, in the 86th District Court.  Fred Peplinski, of Suttons
Bay, is charged with one count of an unauthorized discharge into the
waters of the state, a 2 year felony, and eight counts of Uttering and
Publishing, a 14 year felony, dealing with his operation of the
wastewater treatment system.  Mr. Peplinski remains on bond following a
preliminary examination by the Honorable Michael J. Haley, District
Court Judge for Leelanau County.

The investigation was initiated by the Suttons Bay Police Chief, Del
Moore, after uncovering information of the alleged crime while
investigating another incident.  DEQ's Water Division and Office of
Criminal Investigations responded to the request for assistance from
Chief Moore to determine the extent of environmental violations.  The
Attorney General's Office reviewed the results of the joint
investigation and authorized charges.

Mr. Peplinski had been employed as the wastewater system operator for
Suttons Bay from about 1987 until to his resignation in the fall of
2001.  The illegal discharge alleged in the complaint occurred
continually between July 1997 and September 2001.  The Uttering and
Publishing charges were brought for fraudulent reporting to the DEQ
regarding discharges into the Grand Traverse Bay of Lake Michigan.
