Dow AgroSiences agrees to pay $2M to state over pesticide ads

Dow AgroSciences LLC, a subsidiary of Dow Chemical Co., has agreed to
pay a $2 million penalty to the state of New York. It is the largest
pesticide enforcement penalty ever, according to Attorney General Eliot
Spitzer's office.

The payment is being made to resolve a dispute with Spitzer over
advertising claims the company made about the safety of its pesticide

In a written release, Down AgroSciences said it was making the payment
"as a means of resolving the dispute without protracted litigation, and
in order to obtain an affirmation of the company's right, in the state
of New York, to correct false statements about its products."
