Judge Paula Landerfield in Ingham County Circuit Court dismissed charges
of obscenity against 83 year old farmer Gerald Henning, brought as a
result of the Michigan Department of Agriculture's referral of his
comments on their Right to Farm Act hotline to the Ingham County
Prosecutor as "obscene".  Henning, who has been diagnosed, along with
his wife, with neurological symptoms consistent with chronic exposure to
hydrogen sulfide which is a known by-product of wastes from concentrated
animal feeding operations, had left messages dozens of times with the
Right to Farm Program at the MDA, over the course of years, getting
inadequate responses at best.  The charges were filed by a retiring MDA
official as he retired, one can only assume somewhat out of spit.
Unfortunately, this gesture has resulted in putting Gerald Henning in
the position of not only having to continue to live with the horrific
and unhealthful effects of the odors from this operation (as well as
water contamination), but also defending himself against prosecution for
attempting to be heard by the state agency whose job it was to protect
Gerald's interests.

right to express our displeasure with public agency actions!
