I have placed the published decision
by the Michigan Court of Appeals trashing Great Lakes shoreline
beachwalking below the high water mark at:


One of the most annoying things about the Michigan
news media on these court decisions is they never tell
you the names of the judges making decisions in
their articles writing about such decisions.   Unfortunately,
the Detroit Free Press and the Detroit News, in their
"wisdom," have a vested interest in not telling the public
which judges make these decision because they take
the position that such judges should always be appointed
by the governor rather than being elected by the people
as they presently are.   Then, after not telling us who
is making these decisions, DFP and DN editorial writers
tell us that the public is incapable of making these decisions
at the ballot box....another case of arrogant corporate
media not telling you the whole story.

In the decision to trash Michigan Great Lakes beachwalking,
the judges were Peter O'Connell, Kurtis Wilder and
Christopher Murray....   There's nothing magical about
a 3 judge panel of the Michigan Court of Appeals...they are just
3 politicians entrusted with making decisions that affect
a lot of people.

In the present case,  Wilder and Murray have never been
elected to the Court of Appeals.   They were appointed to the Court by John 
to replace vacancies.   Wilder is so proud of his
Federalist Society membership that he has it in his official

All three of these judges will have to stand for election/re-election
so it is important to have a long memory at election time.....these
judges can be replaced by the voters because of decisions they make.
