This decision will further restrict the use of MEPA as a check on inadequate government enforcement and regulation.  Now, in addition to proving an injury to the environment, MEPA plaintiffs will have to prove an injury to themselves which is more particular than that suffered by the general public.  This opens the door to much litigation over "personnel injury" issues which are generally collateral to the main issues of a MEPA case, and just makes it that much more expensive and difficult to go to court.  Not a great day for citizen environmental enforcement in Michigan.

Reading between the lines....    Looks to me like the
male republican judges on the Michigan Supreme Court
have something in for Judge Weaver...a republican female
supreme court judge.

This is the most divided looking unanimous court ruling
I can possibly conceive of....
