Sorry for the confusion. The takings case I referred to was not
mentioned in the free press editorial about the Michigan Supreme Court
cases. 
 
The takings case was a ruling by Circuit Judge Calvin Bosman in Ottawa
County. The GR Press article has the story (except for the erroneous
part about DEQ not appealing).

Appeal?  To what court?  and on what grounds?  Regardless of whether you
think these cases were properly decided or not, they are clearly purely
state issues, with no federal law questions.  There is absolutely no
basis for the U.S. Supreme Court to grant cert in this case.

I heard from the DEQ leadership that

1) Grand Rapids Press got it wrong, and

2) DEQ will appeal the decision

I'm glad to set the record straight.

I don't know all the details of the takings ruling, but does anyone know
why the DEQ is not going to appeal the decision (as was reported in the
GR Press yesterday)?
