"...Added to penalties that were part of a lawsuit settled last year, the dairy company will owe $403,500 to the state for violating court orders and environmental regulations. Still unsettled is when the money will be paid.
The DEQ wants a court order for immediate payment. Vreba-Hoff is asking to make monthly payments after it is allowed to add nearly 1,000 cows to 6,500 now producing milk.
The penalties are recommended in a report written by retired Judge Lawrence Glazer, who was appointed last fall to mediate a dispute between Vreba-Hoff and the DEQ. The dispute involved complaints that Vreba-Hoff violated a court settlement on management and treatment of manure at the dairies...
...Judge James Giddings of 30th Circuit Court in Ingham County has been asked to decide when Vreba-Hoff must pay the new penalties. O’Donnel said a hearing was requested that he expects will be conducted before the end of this year. 
In his report, Glazer said Vreba-Hoff 'asserts that it is financially impossible for it to pay any substantial penalties at present.' The dairy company asked to make monthly payments over a one-year period after the treatment systems are certified and the dairies reach their limit of 7,470 cows in production."
