Group report issued recently on water enforcement on Michigan, Ohio and 
Pennsylvania

The EWG "report" presents a very limited and biased evaluation of 
enforcement efforts. They selected only a couple dozen of over 10,000 
regulated industrial and municipal dischargers for this report.

At least one of the facilities is the subject of current enforcement action 
that will result in a $12,000,000 settlement which will be announced later 
this month by the United States Department of Justice.

Errors in the compliance data used have also been noted. For example, Mead 
Paper is reported as being in "significant Non-compliance" for 8 out of the 
past 8 quarters when in actuality they had only one BOD violation during 
this period. The "sector facility indexing project" data of USEPA used in 
the EWG report is seriously flawed.

For a more complete picture of water quality enforcement actions in 
Michigan, you may review the attached Excel spreadsheet summarizing 197 
settled cases (from 1991 to 1999) and total settlement amounts of 
$41,500,000 (including civil penalties, recovered costs, supplemental 
environmental projects, and recovered natural resource damages) as a result 
of enforcement actions by the Michigan Department of Environmental Quality 
(MDEQ). More detail on specific case settlements can be found on the MDEQ 
Surface Water Quality Division web pages @ www.deq.state.mi.us/swq or you 
can come in an review our files.
